ELIGIBILITY: The Funkmaster Flex Custom SUV Giveaway ("Promotion") is open to legal residents of the 50 United States (including the District of Columbia) who are 18 years of age or older at the time of entry. Residents of Florida have a delayed start date; see below for details. Employees of Microsoft Corporation ("Sponsor"), its parent company, subsidiaries, affiliates, assignees, officers, directors, distributors, retailers, advertising/promotion agencies and Project Support Team, Inc. ("Administrator") (collectively, the "Released Parties"), and any such employee's immediate family members (including mother, father, sister, brother, child, spouse, and their respective spouses, regardless of where they reside) and those living in their households (whether related or not) are not eligible to enter or win (however Microsoft Student Partners are eligible). Promotion is void in Puerto Rico and where prohibited. Promotion is subject to all applicable federal, state and local laws.

HOW TO PARTICIPATE: This Promotion begins on April 3, 2009 at 11:59:59 PM Pacific Time ("PT") and ends on August 31, 2009 at 11:59:59 PM PT (the "Promotion Period"). However, residents of Florida may enter beginning at 12:01 AM PT on April 9, 2009. During the Promotion Period, visit www.zune.net/flex, complete all required fields as indicated on the Official Entry Form, download Zune software and set up a Zune account and provide the correct "Song of the Week" to receive one (1) entry. NOTE: The Zune software and account are free and may be cancelled at any time. Failure to provide complete and accurate data will result in automatic disqualification. There is a limit of one (1) entry per person and per email address per day for the duration of the Promotion Period. Additional entries received from any one person or email address on any given day after the first entry received from that person or email address on that day will be void. The Website's database clock will be the official timekeeper for this Promotion. In the event of a dispute as to the identity of an entrant based on email address submitted on the online entry form, entry will be deemed to be from the email account subscriber of the email address at issue, as determined by Sponsor in its discretion regardless of the name that appears on the Official Entry Form. Email account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses. All entries become property of Sponsor and will not be acknowledged or returned. The use of any devices to automate entry, including but not limited to entries submitted using any bot, macro, script, hack, online sweepstakes service or form-filling software (or any other devices intended to automate any part of the entry process) to gain an entry into this Promotion is prohibited. Entries by any means which subvert the entry process will be void. If Administrator or Sponsor, at their sole discretion, determines that any entrant has used any device to automate or subvert the entry process, all entries from that entrant will be void and future entry attempts by the entrant at issue may be blocked. Released Parties are not responsible for telephonic, human or computer software or hardware failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, phones, phone lines telephone systems, network, cable, satellite, Internet Service Provider (ISP) or any other connections, traffic congestion on the Internet or at any website, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise, non-delivery, misdirected, blocked or delayed email notifications, or for typographical, printing or other errors appearing in these Official Rules or other Promotion-related materials, or for any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Promotion or downloading any materials in this Promotion, or for any other errors or problems of any kind, including, without limitation, errors or problems which may occur in connection with administration of the Promotion, the announcement of the prize or the processing of entries or any other Promotion-related materials. Released Parties are also not responsible for incomplete, unintelligible, inaccurate, lost, misdirected, garbled, late, stolen, delayed, damaged, undeliverable or mutilated entries or entries containing false information of any kind and all such entries will be void. CAUTION: Any attempt to deliberately damage any website or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies (including attorneys' fees) from any such person(s) responsible for the attempt to the fullest extent allowed by law.

DRAWING/ODDS: One (1) potential Grand Prize winner will be selected from amongst all eligible entries received throughout the Promotion Period by means of a random drawing conducted on or around September 8, 2009. Odds of winning the prize depend on the total number of eligible entries received throughout the entire Promotion Period.

ONE (1) GRAND PRIZE: One (1) pre-owned 2008 Ford Explorer Sport Trac Limited 4x4 SUV with the following vehicle accessories/upgrades: Kicker Sound System (8" and 6.5" Kicker speakers in front doors with custom fiberglass pod), 6.5" Kicker components in rear doors, four (4) 8" Kicker subwoofers behind rear seat, two (2) Kicker amplifiers, car PC mounted in center console powered by Microsoft Windows XP, Live Internet on the go via Sprint wireless AirCard, one (1) Slingbox media player, one (1) wireless keyboard (with mouse), (4) TVs (two (2) 7" factory headrest monitors with one (1) built-in DVD player), one (1) 10" flip-down monitor with VGA input, one (1) converted factory screen in-dash, custom display mount, full Katzkinz custom interior, suede headliner/interior parts, one (1) Xbox 360 console and a custom Zune paint job. Approximate Retail Value: $50,000. Winner must provide proof of valid auto insurance and valid U.S. driver's license to take delivery of vehicle and must take delivery of the vehicle at a location specified by Sponsor in its sole discretion. Any options not included in vehicle as awarded are winner's sole responsibility. Vehicle is awarded "as is" and is not under any existing warranty, including but not limited to any factory or manufacturer's warranty. In addition, Sponsor makes no warranty, representation or guarantee, express or implied, in fact or in law, relative to the nature of the prize awarded, including but not limited to its quality or mechanical condition. Title, license and registration fees and insurance for vehicle and travel or other costs associated with taking possession of vehicle and any other expenses associated with prize not explicitly stated herein are winner's sole responsibility. Vehicle color and any other specifics of the prize not specified herein shall be determined solely by Sponsor. Vehicle is pre-owned and utilized in connection with this Promotion. Approximate mileage of vehicle at time of award: 750 (estimated). Federal, state and local taxes and all other expenses not specified herein are the sole responsibility of the winner. No transfer, cash redemption or substitution of prize is permitted, except that Sponsor may, at its discretion, substitute the prize with a different prize of comparable or greater value. All prize details are at Sponsor's sole discretion.

MISCELLANEOUS: The potential winner will be notified on or about September 8, 2009 by mail, overnight delivery, email or telephone and will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within ten (10) business days of date of receipt of documents. The potential winner may also be required to provide proof of enrollment at an accredited two or four-year college or university. Failure to comply with the specified time period or with these Official Rules, the return of prize notification as undeliverable, or Sponsor's inability to contact a potential winner within a reasonable time period will result in forfeiture of the prize and, at Sponsor's sole discretion, the prize may be awarded to an alternate winner. By entering, all entrants agree to abide by these Official Rules and to the decisions of the Sponsor and judges, which shall be final and binding in all respects, and further agree that: 1.) Sponsor and its designees and assigns may use (unless prohibited by law) their names, cities and states of residence, photographs and/or likenesses for advertising and/or trade and/or any other purpose in any and all media now or hereafter known worldwide without limitation and without further compensation, permission or notification, and 2.) Released Parties shall have no liability and will be held harmless from any liability, loss, injury or damage to any entrant or any other person or entity, including personal injury or death to entrant or any other person or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Promotion. Sponsor reserves the right, in its sole discretion, to void suspect entries or claims and/or cancel, terminate or suspend any portion of this Promotion should a virus, Trojan Horse, worm, bug, Denial of Service ("DOS") attack, non-authorized human intervention, tampering, fraud, or other causes corrupt or impair the administration, security, fairness, integrity or proper play of the Promotion and, in the event of cancellation or termination, at its discretion, select the Grand Prize winner from eligible non-suspect entries received prior to the event requiring such termination or cancellation.
